Drinking while shopping: A dangerous holiday mix?

30/12/2011 - What better way to end the year than with a story about the holiday season's two most obvious cultural trends? As much as consumers love to shop and enjoy a drink during the holidays, the two don't seem to go together, and new research proves it.

A recent British survey found roughly half of all respondents admitted to making impulse buys while under the influence, and according to a New York Times article, a number of online retailers have seen an uptick in nighttime traffic this holiday season.

But these blurry, hasty purchases raise questions about return policies, namely whether a shopping-while-drunk excuse is actually legitimate. It also begs the question: Wouldn't reckless online shopping be good for sales, or at least better than in a brick-and-mortar shop?

"People who are under the influence have the legal capacity to consent," explains legal expert Stephanie Rabiner for Reuters. "Most courts will enforce such contracts - or purchases - unless the other party took advantage of the intoxicated person. This is why you don't want to directly encourage the behavior."
