What better way to end the year than with a story about the holiday season's two most obvious cultural trends? As much as consumers love to shop and enjoy a drink during the holidays, the two don't seem to go together, and new research proves it.A recent British survey found roughly half of all respondents admitted to making impulse buys while under the influence, and according to a New York Times article, a number of online retailers have seen an uptick in nighttime traffic this holiday season.
But these blurry, hasty purchases raise questions about return policies, namely whether a shopping-while-drunk excuse is actually legitimate. It also begs the question: Wouldn't reckless online shopping be good for sales, or at least better than in a brick-and-mortar shop?
"People who are under the influence have the legal capacity to consent," explains legal expert Stephanie Rabiner for Reuters. "Most courts will enforce such contracts - or purchases - unless the other party took advantage of the intoxicated person. This is why you don't want to directly encourage the behavior."
